Disability Discrimination Claims

Since its founding in 1972, Lippman & Semsker has represented hundreds of individuals, both in the government and in private industry, in employment-related claims, including discrimination based on race, gender, sexual orientation, age, national origin, religion, and disability, as well as harassment and retaliation cases. The Americans with Disabilities Act (ADA) and the Rehabilitation Act of 1973 prohibit employers from discriminating against an individual due to disability in the terms and conditions of employment, and similar state laws outlaw disability discrimination in D.C., Maryland, and Virginia. Those same laws also prohibit retaliation for exercising the right to complain about perceived disability discrimination.

The ADA is relative new law and the case law is still developing in this area. Unfortunately, trying to determine whether you are protected by the ADA is not always a straight forward question. Many people suffer from an ailment that is only temporary while others suffer from a conditions that precludes them performing some jobs but not all jobs. In both these situations, an individual may not be protected by federal law because of the way the law is written. It is important to consult with an experienced lawyer immediately if a disability issue arises at work to make sure that your rights are protected to the full extent of the law.

In the decades since these laws were first written, employers have become wiser. While most employers work hard to make sure discrimination does not happen, when it does happen employers rarely acknowledge it. Often-times, disability discrimination is disguised or difficult to prove.
